TERMS OF SERVICES

User Agreementby commissioning me, you agree that you have read and accepted my Terms Of Service:

- The client is 18 or above and is in a state where they are able to accept these terms.- The client is paying for my services and skills as an artist. The commission and my work thus are not limited to just the finished artwork, but also encompass the entire creation process, nor will a physical object be provided. The client does not receive the rights to replicate/imitate my artstyle or use by-products of the work process or similar.- Clients are granted exclusive usage rights to the finalized works as agreed upon, which may not be transferred to other parties unless explicitly agreed upon or in cases of inheritance.- The client has to provide all relevant information regarding intended project usage and agrees to discuss additional uses or changes with me, the artist.- My work by default, unless otherwise stated, is for personal or private use only, meaning I do not allow my art to be used for unauthorized commercial purposes unless commercial usage is specifically agreed upon and commercial licenses are provided by me.- As the artist I retain the copyright and ownership to the commissioned works and all other applicable rights. This includes but is not limited to; claiming authorship of the work, publishing the work on my socials, adding it as a part of my portfolio, including the work in artbooks and editorial projects and monetizing the commission in any which way I deem fit and is within my rights.- Neither client nor anyone else is allowed to edit, trace, copy, heavily reference from or imitate the commissioned work in any way or use it as assets, including but not limited to the use of the artwork as a "base" or removing the watermark from the finished product.- The client may not claim my art as their own creation under any circumstances. Credit to me (ArkuAureus) as the artist must be given, explicitly or by linking to a website or social media account belonging to me unless otherwise agreed upon.- My art, whether commissioned, pre-existing or merchandise work, must not be minted into an NFT (Non Fungible Token) or used in connection with cryptocurrencies by commissioner nor anyone else.- My art may not be uploaded to any AI database or be utilized to create AI art in any form.

Ordering

- I reserve the right to refuse any project.- I require a full description, if possible, with references, before approving the project.

Payment

- All payments must be made through invoices provided by me.- Totaling above 350€, payments may be split, with 50% due up front and 50% due upon sketch approval or first work in progress.

Refunds

- Refunds have to be discussed with me, the artist, on a case-by-case basis.- If a project cannot be completed due to incapacitation of the artist, the client will be offered a refund and project deliverables based on current project completion and scope on a case-by-case basis.- The client agrees not to file a chargeback without first contacting me.- Completed projects are non-refundable.- Should a chargeback be filed without prior discussion, the commissioner will lose all rights to the corresponding works being charged back and any current or future projects are immediately nullified. I have the right to dispute the chargeback and pursue legal action if necessary.- Rude/disrespectful/abusive commissioners will have their commission immediately cancelled with a refund based on how much of the commission was completed.

Active Project

- I may stream the process of the commission and post it on social media. The client agrees to specify in their order if they wish for any materials or work to be hidden.- In case of a noteworthy delay, I will contact the client to discuss the new scope and schedule.- I can provide additional WIPs by client request when time is available.- If the client fails to respond to feedback/revision requests within 7 days, I reserve the right to continue with the project as I deem fit.- Continuous non-communication of two weeks may result in the project to be considered finished in its current state and will be sent to the client.

Commission procedure

- Commissioner will be contacted to confirm information and scope of the commission.- If you would like to see additional WIPs of your commission, please don't hesitate to ask.

Project Delivery and Revision

- Upon final project delivery, I will keep the project open for a week for final revisions. The client is to contact me for revision requests through the already established communication methods.- Once the artwork is finished, I can do small changes such as color adjustments and/or adding minor details I may have forgotten.- I will only make changes to the final piece if it was an error on my part (i.e. I missed a detail that has been provided in the order).- Revision requests made after the project has been finalized may be considered a rework and will be processed and scheduled as such.- The responsibility is on you to ensure your order contains the details you want me to follow. I will not substantially redraw commissions unless payment is sent for a second order.

Usage Rights and Credits

- I reserve the right to post completed projects to my website and social media accounts, unless otherwise agreed upon.- The client agrees not to use project deliverables to create any derivative works, repurposed assets, or for any commercial purposes outside of the initial intended use.- The client may contact me to discuss any additional uses after a project is completed.- The client must appropriately credit me, the artist, on all social media and streaming platforms where project deliverables are used. I will provide preferred credits upon project completion.

Terms of Service Changes

- I may choose to revise these terms at any point.- The updated Terms of Service will apply from then on, including on previously finished commissions for past clients if for those commissions, for example, reworks or additional licenses are requested.- If changes are made, clients with pending projects will be informed and asked for confirmation on accepting the new Terms of Service.
